The eIDAS Regulation is an EU regulation for electronic signatures. It is one of the international regulations used to standardise the terms of electronic signatures.
With biometric verification, Yoti Sign gives the sender confidence that the signee is who they say they are. When the sender requests Yoti verified attributes from the signee, such as Full Name and Photo, this meets the requirement of an ‘advanced’ electronic signature under eIDAS.
When the sender only requests email authentication, this is still a valid electronic signature under eIDAS.
For US organisations, Yoti Sign can be configured to meet the requirements of the E-Sign Act and the Uniform Electronic Transactions Act, by requiring the signee to accept the Consumer Disclosure Agreement (link to FAQ).
Electronic signatures can be legally binding for the majority of contracts globally. The signature is the underlying technology that helps confirm the authenticity of the interaction between the two parties. However, it is not advised to use an electronic signature to sign family law documents, probate documents or when the signature needs to be witnessed (for example, when signing a deed). Please seek legal advice to check electronic signatures are valid for documents in your territory.
